Article 1: Application of these general terms of trade
Placing an order with CLAIRE SOURCE implies the total and without any reserve acceptance of the purchaser of these general terms of trade, excluding all other documents such as leaflets, catalogues issued by the salesman and which only have an indicative value. The order is recorded as soon as the Net surfer has clicked the button “validate my order”.
Unless otherwise to the present conditions agreed between the parts and specified in writing, the orders are ipso jure subjected to the present general terms of trade whatever the clauses appearing on the purchaser’s documents may be.
Article 2: Order and payment modalities
Orders are only final when they have been confirmed by the payment of the price by the purchaser. Payment of products can be done by check (by mail), by mandate, by transfer to Belgium (please contact us) or by credit card (by telephone, by fax). Total payment comes into effect in totality as soon as the customer confirms his order on the Internet site. A confirmation of your order will be sent to you by email. The invoice will be enclosed with your parcel. We reserve the right to cancel an order in the following case: invalid card, you will be advised by email.
Credit card payments are secured by an on line payment system SSLstandard. Products remain property of SOURCE CLAIRE until full payment of invoices. All our offers apply within the limit of available stocks or temporary or final stock shortage. If only one product of your total order is out of stock, the available products will be sent to you and the “missing one” subsequently with your agreement. You can be sure that we will contact you.
Article 3: Prices
The prices are indicated in Euros and all tax included (VAT). The price indicated on each product does not include shipping costs. The entire amount due is indicated on your order confirmation by SOURCE CLAIRE. It is the final price to pay, all taxes included. This price includes: product prices, handling charges, packing and shipping costs. SOURCE CLAIRE reserves the right to modify its selling prices at any moment.
Article 4: Shipping costs
For France shipping costs are 6€ whatever the order is.
For the EEC shipping costs are 10€ whatever the order is.
For Switzerland shipping costs are 13€ whatever the order is.
For the DOM/TOM (French overseas department and territories) and other countries please contact us, shipping costs are calculated according to the parcel’s weight.
Article 5: Delivery and reception
The parcels are sent the same day for all orders placed before 1 p.m. with one of the payment methods having been made (see article 2). The parcels are sent in TRACKED COLISSIMO J+2 France. TRACKED COLISSIMO J+3 EUROPE in J+5 TRACKED COLISSIMO DOM in J+5.
For all the TRACKED COLISSIMO, you must sign for delivery, in case of absence, the post office will leave you a calling card. Our shipments are made to anywhere in the world on request. The delivery period calculation D+… takes only working days into account, Saturdays are not included, condition of the Post office’s contract.
For French overseas territories, the parcels are sent by normal mail at your own risks, or by recorded delivery within approximately 10 days.
We are not responsible for the post office’s delays. The parcels’ date of deposit at the post office is visible on the label on your parcel. For any delay complaint, ask for a report from your postman and take steps at their service.
If your parcel does not arrive within the deadlines, please phone SOURCE CLAIRE to ask for the sending number of your parcel and check with your post office. If it does not arrive within 4 days, please call again, we will start an investigation at the post office.
If your parcel is delivered to you in bad condition, we advise you to refuse it and notify us by call. As soon as the parcel’s return to SOURCE CLAIRE, we will send you another one. For possible complaints in the case of apparent defects or nonconformity ofthe ordered products, the products must be returned to us (normal sending, no recorded delivery) in their original packaging and intact, the shipping costs will be at your expense. A new parcel will be sent back to you.
Article 6: Return and terms
L.121-20 article of the consumption code:
To exert a revocation right, the purchaser of Source Claire products has a deadline of 7 clear days from the reception of his order, without any justifying reasons or paying any pelnalties, to return the product for exchange or refunding except for return expenses. If this time expires on a Saturday, on a Sunday or on a public holiday, it is extended until the next working day (L.121-20 article of the consumption code).
L.121-20-2 article (inserted by ordinance n° 2001-741 of August 23th, 2001 art.5 and 12 Official journal of August 25th, 2001.
The revocation right cannot be exerted for the following contracts: :
1°) regarding products (bottles with inviolable closing) that have been opened or consumed and cannot be sent back as they are likely to be spoiled or expire quickly. (Subparagraph 3)
2°) regarding audio recording supplies (CD) when they have been unsealed by the purchaser. (Subparagraph 4) (if the seal of the recording medium has been broken by the consumer)
Article 7: Confidentiality of address, email and phone numbers
The personal data provided by the customers are not communicated to third parts: excepting opposition from you, they are integrated in our company’s record. Concerned with the protection of your private life, SOURCE CLAIRE processes all data related to you with strict confidentiality. At the time of your purchases, we only ask you for the necessary information for quality treatment and careful follow-up of your order.
In accordance with the law 78-17 of January 6th, 1978, the customer can exercise this right, all you have to do is contact our services. |
